On November 22, 2004, a five-count indictment was issued at the Military Court of the IDF Southern Command against an IDF officer of the rank of captain, who served as the company commander at the time of the October 5, 2004 incident in which a Palestinian girl was killed outside the Girit outpost along the Israel-Egypt border near Rafah.

The indictment charged the company commander with two counts of illegal use of a weapon, one count of obstruction of justice, one count of acting beyond the scope of authority in a potentially lethal manner, and one count of unbecoming conduct. It was decided to extend the remand of the company commander for two months and he is being transferred to another base.

The legal proceedings against the company commander continue.
