The Cabinet today approved amendment to the draft Courts Law, according to which binding arbitration will be used in civil claims submitted to the magistrates courts.  The goal of the proposal is to assist in shortening the duration of lengthy judicial processes that harm citizens and damage the image of the court system.

According to the proposal, the magistrates court president or his deputy will be authorized to direct that a civil claim be submitted to an arbitrator.  The arbitration will be conducted by an attorney with experience on the level of a district court judge, or an experienced attorney acceptable to both sides.  The arbitration verdict will require court approval and may be appealed.

In order to expedite the law, the Cabinet authorized the Ministerial Committee on Legislation to discuss the draft and submit it to the Knesset.
